For the purpose of these Terms, unless the context otherwise requires:
“Asia Pacific Region” means Singapore, Malaysia, India, Philippines, Australia, New Zealand, China, Hong Kong, Taiwan, Japan, Korea, Bangladesh, Sri Lanka, Indonesia, Thailand, Vietnam.
“Eligible Visa Card” means any Visa Business, Visa Corporate, Visa Purchasing card issued in the Asia Pacific Region by a Participating Issuer.
“Eligible Visa Cardholder” means the holder of an Eligible Visa Card.
“Participating Issuers” means Visa card issuers who are participating in the Visa Business Hub Program.
“Privileges means the special offers and discounts on software tools and applications which Eligible Visa Cardholders may enjoy through logging into the Visa Business Hub Website.
“Visa” means Visa Worldwide Pte. Limited, a company incorporated in Singapore.
“Visa Business Hub Program” means the program arranged by Visa for the benefit of Eligible Visa Cardholders, whereby Eligible Visa Cardholders may enjoy the Privileges.
“Visa Business Hub Website” means www.visabusinesshub.com.
a) Subject to these Terms, the Privileges are applicable to Eligible Visa Cardholders. Visa cardholders should check with their card issuer to find out if their card issuer participates in the Visa Business Hub Program and if the Privileges are available to them.
b) The Privileges are only available when an Eligible Visa Cardholders logs into the Visa Business Hub Website by entering the first 6 digits of his/her Eligible Visa Card. This is required in order to validate his/her eligibility as well as to process the log in request. Upon successful validation of Eligible Visa Cardholder, the Eligible Visa Cardholder will be able to access the Privileges.
c) The Privileges and related goods and/or services are provided by the respective participating merchants, and are subject to the terms and conditions of the respective participating merchants. The respective participating merchants may amend or change such terms and conditions or to vary or cancel the Privileges without notice. Please check with the respective participating merchants for the latest complete terms and conditions and the availability of the Privileges.
d) The Privileges are available on a first-come-first-served basis while stocks last.
e) To enjoy the Privileges, the Eligible Visa Cardholders have to pay with a valid Eligible Visa Card.
f) The Privileges cannot be exchanged for cash, other products/services or discounts and are not transferable.
g) The Privileges cannot be used in conjunction with other promotional offers, discounted items, fixed price items, coupons/vouchers, bonus point programmes, VIP/membership benefits, or merchant internal offers, unless otherwise stated.
h) Notwithstanding anything in these Terms, Visa may suspend, cancel or modify the Visa Business Hub Program or any of Privileges at any time at its sole and absolute discretion. Visa reserves the right to amend or change these Terms without notice. Visa will not notify the Eligible Visa Cardholders separately of any such change.
i) In case of any dispute relating to these Terms, the decision of Visa shall be final and conclusive.
j) No person other than Visa, or its successors and assigns, and the Eligible Visa Cardholder shall have any right under the Contracts (Rights of Third Parties) Act (Cap. 53B) or through any other means to enforce or enjoy the benefit of any of the provisions of these Terms.
While Visa has used best endeavours to arrange for the Privileges for the benefit of the Eligible Visa Cardholders in accordance with these Terms, Eligible Visa Cardholders acknowledge and agree that Visa and its affiliates are not suppliers of the goods or services provided in connection with the Privileges, and are not responsible for non-fulfilment of any privileges or any defect or lack in service or goods supplied by the participating merchants (including without limitation, gross negligence or wilful default on the part of any of the participating merchants).
Accordingly, Eligible Visa Cardholders irrevocably agree not to make any claim against Visa or Visa’s affiliates in relation to any loss, damage, disappointment or distress of any kind and for any reason whatsoever arising from their use or attempted use of the Privileges, including but not limited to failure or inadequacy of service or fulfilment of the Privileges by the participating merchants.
Any claim, complaint or dispute of any nature arising out of or in relation to the procurement or attempted procurement by an Eligible Visa Cardholder of any goods and/or services under the Privileges shall be settled by the Eligible Visa Cardholder directly with the relevant participating merchant. To the extent permitted by law, Visa shall not be liable to any person for any claim, loss, damages, cost or expense (whether direct, indirect or otherwise) in relation to any personal injury, death, misrepresentation, damage or omission arising from or in connection with the usage or attempted usage of the Privileges or goods and/or services provided under the Privileges.
These Terms are governed by the laws of Singapore. All Eligible Visa Cardholders agree to submit to the jurisdiction of the courts of Singapore over any dispute arising from or in connection with these Terms.
